Terms & Conditions of Purchase and Use

1. PRODUCT DESCRIPTION

The QLM Local Marketing Suite is a set of desktop-based marketing tools designed to assist with lead generation, list management, bulk email marketing, and automated form submissions for legitimate business marketing purposes.

The suite consists of the following individual software applications:

  1. QLM LEAD FLOW – A Google Maps data extraction tool for generating lead lists.
  2. QLM LIST MANAGER – A desktop utility for managing, cleaning, and organizing business data lists.
  3. QLM E-MAILER – A bulk email marketing and personalization tool that allows users to send campaigns through their own configured SMTP servers.
  4. QLM FORM SNIPER – A web automation tool for submitting marketing messages through website contact forms.

Each product is licensed for use in accordance with the terms outlined below.

2. LICENSE GRANT

Upon purchase, QLM.Direct grants the User a non-exclusive, non-transferable, revocable license to install and use the purchased software on up to three of their personal or business computer(s) for lawful marketing and business purposes.

You may not:

  • Distribute, sell, sublicense, or rent the software to others.
  • Reverse-engineer, decompile, or modify the software’s source code.
  • Use the software for any activity that violates applicable local, national, or international laws.

3. USER RESPONSIBILITIES

  • You are solely responsible for how you use the software and any data or information obtained through it.
  • You must ensure all activities conducted using the software comply with applicable laws, including data privacy, anti-spam (such as CAN-SPAM, GDPR, CASL), and website terms of service.
  • You must obtain proper consent before sending emails, messages, or other marketing communications to individuals or organizations.
  • QLM.Direct does not provide or guarantee leads, contact lists, or communication success rates.

4. COMPLIANCE DISCLAIMER

QLM.Direct expressly disclaims any responsibility for misuse or unlawful use of its software.

You agree not to use any QLM product:

  • To harvest or collect data unlawfully or without consent.
  • To send unsolicited commercial communications or spam.
  • To access, scrape, or interact with any online platform or website in violation of that platform’s Terms of Service.

Violation of this clause may result in immediate termination of your license without refund.

5. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • QLM.Direct and its affiliates, employees, and licensors shall not be liable for any damages, losses, claims, penalties, or legal consequences arising from the use or misuse of the software.
  • This includes, but is not limited to, account terminations, IP blacklisting, service suspensions, financial losses, reputational damage, or legal actions resulting from your use of the products.
  • All responsibility for how the software is used lies entirely with the User.

Your purchase and use of the software indicate that you fully understand and accept these limitations.

6. NO WARRANTY

All QLM software is provided “AS IS” and “AS AVAILABLE.”

QLM.Direct makes no warranties, express or implied, regarding:

  • Fitness for a particular purpose.
  • Error-free operation.
  • Accuracy, completeness, or reliability of results.
  • Compatibility with third-party systems, websites, or APIs.

Users acknowledge that scraping, automated submissions, or bulk email operations may be affected by external factors (such as platform updates, CAPTCHA challenges, or server restrictions) outside of QLM’s control.

7. REFUND POLICY

Purchases are protected by a 30-day money-back guarantee.

If, within 30 days of purchase, you experience technical issues that cannot be resolved by our support team, you may request a full refund. Refunds will not be provided for misuse, user error, or violations of these Terms.

8. ACCOUNT AND LICENSE TERMINATION

QLM.Direct reserves the right to suspend or terminate any license or account at its sole discretion, without refund, if:

  • The User violates these Terms or applicable laws.
  • The software is used for spam, data abuse, or other prohibited conduct.
  • Fraudulent payment or chargeback activity is detected.

9. SOFTWARE UPDATES AND SUPPORT

QLM.Direct may release updates, patches, or improvements periodically. Support is provided only to active, licensed users via official communication channels. We are not responsible for third-party conflicts, outdated dependencies, or local system issues on the User’s device.

10. INTELLECTUAL PROPERTY

All software, source code, names, logos, and documentation related to the QLM Local Marketing Suite are the exclusive intellectual property of QLM.Direct. You may not reproduce or represent any part of the software or branding without written permission.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless QLM.Direct, its owners, affiliates, employees, and partners from any and all claims, damages, liabilities, losses, or expenses (including attorney’s or legal fees) arising from:

  • Your use or misuse of the software.
  • Your violation of these Terms or applicable laws.
  • Your infringement of third-party rights.

12. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which QLM.Direct operates, without regard to conflict of law principles. All disputes shall be resolved exclusively in the courts of that jurisdiction.

13. MODIFICATION OF TERMS

QLM.Direct reserves the right to modify or update these Terms at any time. Continued use of the software after any change constitutes acceptance of the revised Terms.
